1. General

1.1 These Terms and Conditions apply to all contracts entered into by CocoZen, LLC (hereinafter referred to as “CocoZen”), the legal entity behind cocozen.org (its official online presence). No modification or variation shall be binding unless agreed in writing.
1.2 By placing an order, you accept these terms and conditions.

2. Sales

2.1 Orders are subject to acceptance by CocoZen, LLC, which reserves the right to reject any order.
2.2 Custom or personalized orders are non-refundable unless defective. Customers are responsible for ensuring the legality of their customization requests.
2.3 CocoZen reserves the right to update product specifications to comply with applicable regulations.

3. Purchase Price and Payment

3.1 Payment must be made in full at checkout. Prices exclude applicable taxes and shipping fees unless otherwise stated.
3.2 Orders not paid in full may be canceled or delayed.

4. Delivery

4.1 Delivery is typically within 7 business days. Notify us if your order is not received within 21 days.
4.2 CocoZen, LLC is not liable for delays caused by events beyond its control.
4.3 Damaged or defective items must be reported within 7 business days of receipt.

5. Returns

5.1 Unused, non-personalized items can be returned within 7 days of delivery at the customer's expense. Refunds are processed within 30 days of receipt of returned goods.

6. Risk of Loss

6.1 The risk of loss or damage transfers to the customer upon delivery to the shipping carrier.

7. Local Taxes

7.1 Customers are responsible for all applicable taxes, including sales tax.

8. Disclaimer of Liability and Safety Acknowledgment

8.1 CocoZen warrants that products will meet specifications at the time of delivery.
8.2 Claims for defective items must be submitted within 7 business days of receipt. CocoZen’s liability is limited to replacement or refund of the item.

8.3 Our CocoZen candles are crafted with care to provide a safe and enjoyable experience. While we stand by the quality of our products, we strongly advise following the included care instructions found in each CocoZen candle box (inside the "Light to Life" Candle Guide book) and/or by going to our Candle Safety page found in the menu, header, and footer of the desktop versions of cocozen.org and can be found in the menu and footer of the mobile device version of cocozen.org as well as multiple hyperlinks in underlined blue words. Please note that CocoZen cannot be held liable for damages resulting from improper use or neglect of the product instructions.

8.4 Furthermore, CocoZen, endeavors to provide high-quality, safe, and responsibly crafted candle products. However, by purchasing, owning, or using a CocoZen candle, the customer, or any person in possession of the candle, agrees to the following terms, waiving any claims against CocoZen, its owners, officers, employees, agents, or representatives:

Safety Features and Precautions
CocoZen takes extensive steps to ensure the safety and quality of its candles, including but not limited to:

Soaking (completely submerging) each coconut shell in salt water (30% salt concentration) for a minimum of 48 hours to enhance fire resistance.
Embedding sand into the base of the coconut shell to act as an additional safety mechanism, helping to extinguish the candle before reaching the bottom (approximately 1/2 inch above the base), in accordance with National Candle Association guidelines.
Providing detailed safety instructions, both with the product and online at cocozen.org, to educate customers on proper use and care.
Despite these precautions, the use of any open flame product inherently carries risks. By using a CocoZen candle, you acknowledge these risks and agree to the terms below.

8.5 Improper use or neglect of CocoZen candles includes, but is not limited to:

• Continuing to burn the candle after the metal stopper or sand becomes visible. This indicates the safe burning limit has been reached, and failure to extinguish the candle at this point increases fire risks.

• Placing the candle on an untested or unsafe surface, such as flammable or heat-sensitive materials, constitutes improper use. CocoZen candles are designed to be used with the provided manila rope base, which has been specially treated for heat and fire resistance and rigorously tested. The manila rope base must always be used in conjunction with a heat-resistant surface to ensure safe and proper use. Failure to follow these guidelines, including not utilizing the treated manila rope base or placing the candle directly on an unsafe surface, is considered misuse of the product and may result in damage or injury.

• Leaving a burning candle unattended or burning it in areas accessible to children, pets, or individuals who may not adhere to safety practices.

​​

• Moving the candle while it is lit or while the wax is still hot, which may cause spillage, burns, or other damage.

​​​

• Burning the candle for more than four (4) hours continuously, which can lead to overheating or structural damage to the coconut shell.

​​

• Failing to trim the wick to the recommended length before each use, resulting in uneven burning, soot, or excess flame height.

​​

• Using the candle in drafty environments that may cause the flame to flicker or flare, increasing fire risks.

Liability Waiver

• By purchasing, owning, or using a CocoZen candle, you agree that:

  • CocoZen shall not be held liable for any injury, property damage, or loss of life resulting from improper use, neglect, or failure to adhere to safety guidelines.

  • CocoZen disclaims all responsibility for damages or injuries caused by intentional misuse or willful disregard for the provided instructions.

  • CocoZen is not liable for any incidental, consequential, or punitive damages arising from the use of its products.

Foul Play and Legal Action

• Any act of foul play, fraudulent claims, or intentional attempts to attribute liability to CocoZen for injuries, damages, or fatalities, including but not limited to misuse, negligence, or deliberate tampering with the product, will result in legal action. CocoZen reserves the right to pursue:

  • Civil remedies, including compensation for damages, legal fees, and other associated costs.

  • ​Criminal charges, as applicable, to the fullest extent permitted by law in all jurisdictions within the United States.

  • CocoZen will cooperate fully with local, state, and federal authorities to investigate and prosecute individuals who act with malicious intent.

Indemnification

• By using a CocoZen candle, the customer agrees to indemnify and hold harmless CocoZen, its affiliates, and representatives from any claims, damages, or liabilities arising from improper use, neglect, or failure to adhere to safety instructions, regardless of the claimant’s relationship to the original purchaser

Applicable Law

• This disclaimer and waiver of liability shall be governed by and construed in accordance with the laws of the state in which the customer resides, as well as applicable federal laws of the United States. Any disputes shall be resolved exclusively in the jurisdiction of the appropriate court within the United States.

9. Your Use of Products

9.1 Customers must follow all safety guidelines and instructions included with products. CocoZen is not liable for misuse as described in this terms and conditions specificity in all of section 8 through 9.

Promotions and Discounts

• Discount codes must be applied at checkout and are valid only during the stated promotional period.

• Free gifts are limited to one per order unless otherwise specified.

• Orders containing promotional gifts are only eligible for refunds if the gift is returned in its original condition.
